I'll make this as short as possible.

when i was 18 years old i was arrested for carrying a knife, since the blade was too long (6") it was considered a felony.
the defense attorney told me that if i pled guilty they would reduce it to a misdemeanor and give me 15 days community service.

so i pled guilty.

they dropped the charge to a misdemeanor and i was given 5 days community service which i performed.
later, i had the crime expunged.
legally, under California law i am not required to write anything in the section that asks about background. businesses should not be able to see my record.

I later worked at an ATM company which i was required to take a full background check, lie detector and all.
i worked there for 3 years.

after that, i got a job as an air conditioning technician, at a company i worked at for 1 year.

When i went to apply for another air conditioning company i started being turned down for jobs and no one would tell me why. (i was in Nevada and they don't honor my expungement)

i was forced to move back to California and i am employed as an air conditioning technician, but this job pays an average of $300 per week.

once again, i have been applying for jobs that sound like they are going great, and they never call me back.
I applied for a job today, i aced their test, and they told me i have the job as long as my background check comes up clear. (so, for the first time, i know exactly what the problem is if i don't get hired)
i have to call them on Monday.

it's my understanding, since the 1990's, there has been changes in the laws regarding the NCIC database which allows people (background businesses) to access them.
the big problem with the NCIC database is they are not complete records, NCIC only records arrests and doesn't record the outcome of the case.

there is a solution to this, but California refuses to "seal" records of crimes of anyone over the age of 18.
lawyers have told me i'm wasting my time trying to get it fixed.

so basically, like what happened to me in Nevada, the government is telling people i've been arrested for a felony, but failing to tell them that my case was reduced and expunged.

I'm not the only victim of this, there are petitions that have started on the internet.

anyways, i need to people to know about this, and pray for me because on Monday my life might take a dramatic turn for the worse.

i probably won't post anymore on this thread.
i'm not asking anyone to post,
but i will read any replies that are left.
thank you.

Hello :

Print whatever proof of the error you have.

And each time you complete the employment application submit this proof with the
application. That way, the interviewer will know you are sincere and honest, and usually
background checks are completed by outside profile services. Not the place you interviewed
at.

So if you do not let the interviewer CODE / flag YOUR application, with this update, then
the results will be shocking when the profile returns.

And Please do not disappear and never respond.

I want to find out why you say Monday ?

And I will hold you in prayer.

Also my email off post is :

Blessings !

Praying for you Wolfestrike and thinking what Betty said is good advice. Let us know how it goes x

I keep coming in here reading your post and wishing I could pull some comforting words and encouragement and since I can't I thought of one who can smile.gif

Matthew 6:34
Take therefore no thought for the morrow: for the morrow shall take thought for the things of itself. Sufficient unto the day is the evil thereof.

1 Thessalonians 5:2
For yourselves know perfectly that the day of the Lord so cometh as a thief in the night.

Keep your focus on Him and don't look down, like Peter. And you will get through all the persecution, disappointments, and earthly stumblingblocks. We seek a better homeland, where justice prevails and mercy and forgiveness abides, where all of your past faults and failures and sins are washed in the blood of the Lamb.

Blessings to you for strength and faith-no matter what happens!

that's a good idea and i have nothing to lose by doing that.

the problem is, society seems to be turning red light/green light.
they punch your name in the computer and it comes back red or green, and no one wants to hear a story.

especially if they hear the "F" word , felony.

...but i'll try it.

Vince.. if you are a believer.. your Father knows what you need.. and will provide..

please remember.. what HE knows you need, may not be the same as what you think you need..

may He grant you faith in Him to trust Him, that what He brings about in your life is for your good..

when all else fails.. trust HIM..

count me as one praying for your request..

I pray for you Vince, that every aspect of your history will be treated in the right context, according to God's Will in Jesus Name.

Dearest Vince :

I have worked directly to support a young married man and his supportive wife, due
to his wrongful felony.

And I know and understand the civil court system, employment background checks, etc.

The KEY, is to present the document face to face in a integrity fashion to the interviewer
at the time of the application.

If you have completed the application, call first thing on Monday and rise up early to
be direct, bold and honest . . . with the interviewer before this situation is like your
other rejections.

FAITH WITH WORKS, is Biblical advice well received and will set you up for an
opportunity, instead of the condemnation due to your silence.

Let me know, if I can help answer other questions in this area. If you go to my screen
name crownsevenalphabet, my blog site is posted : ( contains consumer advocate
information )

Blessings . . . and the end results of my involvment with the young husband, I
talked about at the beginning of this post, is that he did not go to prison, he was
put under probation. (which was still not correct) However, the liars that trapped
him, God made a way to escape the prison, Praise His Holy Name [IHVH]

And the method of application/employment steps, that I suggested to you, he uses
in every day life when and if, the situation rears its ugly head !

sounds very good Crowns....I will pray that the grace of God comes upon those whom receive your application and opens their heart to you truthfulness..and gives you the job you desire... The LORD is with THEE...and will lead you. 1dsz5e4.gif

WS sorry to hear your having to deal with these things...My son-in-law knows this feeling all to well...He has 2 felonies on his record from his younger days and it has hampered him tremendously...He is an Ironworker that works at the plants here in Texas. It's fantastic money, but the law changed and now most great paying plant jobs cannot hire anyone with a felony.

He joined the Union now and is more protected, but his record closed doors to him....

Will be praying...

GOD is BIGGER than anything that is in our past. HE can open doors that no one else can open. Believe HIM and take HIM at HIS WORD. The WORD doesn't come back void. I will keep you and your situation in my prayers.

Abba, I left up Wolfstrike...and ask that you bless him. Show that you move outfrom the need of mans approvel. I ask that you set those in his path that will see his heart, and not the past, and see the hope that is inside of him. I ask that you give him peace inside as well. In Jesus name, Amen!

Hugs!

biggrin.gif I got the job!
now hopefully I will be able to prove myself valuable.

I applied at over 10 places.
the last company I went to, they gave me a test and the manager said he's never seen anyone score so high, ...and still i wasn't hired.
...all of these places and no one would hire me or tell me why i wasn't hired.

When i was in Nevada the background places made employers think i had been to prison.
I tell my story because people should know about the unfairness of the NCIC database.

now my problem seems so small when before it felt so large.

something told me to post here to get more people involved, and it looks like it worked. smile.gif

I will set aside more time to read about other's problems here, to pray and try to return the favor.

I thank you

it turns out my legal problems may have only been in Nevada.

when i told my boss i was leaving, he tried to send people to figure out what company i was going to.
it looks like my original suspicion may have been correct that my boss was giving me bad reviews to keep me at my low paying job.

i'll probably find out tomorrow because the new company is sending me to a class they're paying for, and i haven't even started working there yet.

i'm not going to allow these people to treat me like this, if my new job goes bad, i guess i'll go back into working security.

all i want is a "normal" life.

Good Morning Wolfstrike :

You should discuss this with your new boss.

Unless you already did.

The open communication with the new boss, about the lack of equal opportunity you
experienced from the old boss, will set up a positive respect level.

See, the boundary setting needed, is in letting the truth be stated, behind closed doors
with your new boss.

Do not discuss any of this with the new employees. It makes you look like a problem
waiting to happen.

Say to your new boss ( private ) . . . " I am really looking forward to this paid training,
something my former company prohibited me from doing ".

Also state, " I look forward to using these new training skills to assist your company with
their goals and I already see, how I can apply them to my personal growth and financial
goals ".

All these affirmations, tell the TRUTH, stop you from repeating being the victim, put the
new boss on notice to pay notice to your continuance to be a valued employee.
Josepha Cobbi
I agree with you Betty. Very good advice!

i always get good advice here smile.gif
Messiahiscoming
I just wanted to tell you that I am so glad that the Lord is moving in your life! We do have a God that cares... and is concerned about our needs. I am reminded of this scripture in Hebrews....

Hebrews 4:14-16
14Seeing then that we have a great high priest, that is passed into the heavens, Jesus the Son of God, let us hold fast our profession.
15For we have not an high priest which cannot be touched with the feeling of our infirmities; but was in all points tempted like as we are, yet without sin.
16Let us therefore come boldly unto the throne of grace, that we may obtain mercy, and find grace to help in time of need.

What an honor to have a God that understands our struggles and trials...... and how great it is to be able to BOLDLY approach His throne, to find mercy and grace meeting us there in our every need!

I am praying that your new Job will bless you.... and that you will be a blessing in-return to others!

Love in Christ,
Val

Just a thought....if your old boss causes more trouble for you, you might consider going into the District Attorney's office and asking for advice on how to legally stop him. What he's doing is unethical and you might be able to make it illegal too. God bless you in your new job.
Josepha Cobbi
I agree with sharon, this is harrassment.
Humble Bob
If the old boss can't track you and you're a shoe-in for the other job I say leave it be. I think people who do bad things to others will have it catch up with them one day. Keep looking forward and keep your powder dry and God bless, WS.
Wolfstrike
thanks folks. smile.gif

i got the new job and everything is going fairly normal now.
i think my old boss may have said something negative, because the new placed asked me to go over my work history again, but it doesn't seem to matter now.

i applied at many places and had no luck dispite tha fact i was scoring very well on some company tests.
...and no place tells you why you weren't hired these days.

i got the feeling i should post here, and it seems my string of bad luck has ended for now.

...all i have to do now is focus on my job performance at the new place.

thanks again, i feel it made a difference.

Josepha Cobbi
WS, I am very happy to hear this, but it is not us that you should thank for all this breakthrough, but HIM who made us!
All Praise to God, for whom nothing is impossible!

Sounds like your boss was black balling you. They usually get it in the end..

Just stay steady and provide the new company you work for a positive work proformance and that will erase anything negative your old boss may have said about you.

Put your past behind you and keep on truckin forward~

i thought it might be a good idea to post a link of an online petition regarding the NCIC database and it's inaccuracies.

May the accuser of the brethren be cast down. In the name of Jesus Christ I rebuke you Satan. You are quite a pork chop! You Pig! I command you to loose your hold on him and on his course. I loose the spirit of liberty and forgiveness right now in the name of Jesus and command that the teeth of the accusers be broken in their mouths. Destruction and misery unto all who lay a snare for the innocent and just.
